Attorney Edd K. Roberts III was featured in the News & Observer regarding a case involving a homicide in Wake County. Roberts represented James H. Courtney III, who had previously faced a Wake County jury on accusations that he murdered James Carol DeBerry seven years prior. A mistrial was declared in 2010 and the charges were dismissed in 2011. Yet, in 2015, charges were brought again against Mr. Courtney.
The case involved multiple suspects, and destroyed evidence, as the items used for the first trial were not available to the defense for DNA testing before the second trial. Roberts argued that prosecutors had not met the burden of proof beyond a reasonable doubt in Mr. Courtney’s second trial for first degree murder and the jury agreed, convicting Mr. Courtney of the lesser crime.
